TP/3474/2025 (E-filing) Mr. Mehul Shah a/w. Pushpa Thapa, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Jaisukhlal Revashanker Vora being sole Executor named under the Will of deceased. The deceased namely Navalben Revashanker Vora died at Mumbai on 11.07.1986. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 05.06.2025 for dispensation of identification proof of deceased. The same is accepted.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 28.06.1986. The said Will is in Gujarati language and official translation of the said Will of office of Chief Translator, High Court, Bombay is filed separately through e-filing. The Page No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. As stated in para No. 9 of the petition, deceased was survived by one son, one daughter-in-law and nine grandsons and five granddaughters. Out of them son is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Bharat Savailal Dagli and Harsha Bharat Dagli dated 05.06.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 04.08.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
