TP/3510/2025 (E-filing) Ms. Riya Vasa i/b. Joran Diwan, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Sajjan Jhunjhunwala and Amritlal Gupta being Executors named under the Will of deceased. The deceased namely Rajdulari Gopikishan Rungta died at Mumbai on 28.08.2016. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 16.10.2024 for non-availability of identification proof of deceased. The same is accepted.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 24.12.2008. The said Will is in English language. The last para of 1st page of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein. Residuary clause in respect of properties of deceased is mentioned at 2nd para of page No. 2 of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. As per para No. 9 of the petition, deceased was survived by two daughters, two grandsons and one granddaughter. Out of them two daughters have given their consents in favour of the petitioners. Consent Affidavits are on record. The grandson namely Harsh, Sharad and granddaughter namely Shailaza have been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 24.09.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Kamlesh Chokhani dated 16.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 12.08.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
