TP/3602/2025 (E-filing) Ms. Ridhi Shah i/b. Shah and Furia Associates, Advocate for petitioner P.C.: 1. Perused petition. Heard Ld. Advocate for petitioner. As per praecipe dated 04.08.2025, Ld. Advocate for petitioner prayed for refund of court fees as per the Government Notification bearing No. Mudrank-2023/C.R.641/M-1(Policy) dated 09.08.2024. This petition is filed by widow of deceased for Letters of Administration to the property and credits of deceased. In this petition, petitioner has paid maximum court fees of Rs. 75,000/-.
2. Ld. Advocate for petitioner submits that court fees for widows by filing probate of Will or Letters of Administration, with or without Will specified in Article 10 of the First Schedule appended to the Maharashtra Court Fees Act, 1959, for obtaining heirship certificate has been reduced from Rs. 75,000/- to Rs.10,000/-. This petition is filed on 28.03.2025 and therefore, the said Notification is applicable to this case. Para No. 4(a) of the petition states that petitioner is widow of deceased therefore, the said Notification is applicable.
3. Ld. Advocate for petitioner has produced the copy of defaced challan, GRN No. MH 018611796202425P and CIN No. 10000502025032512036 in the name of petitioner namely Rajasree Krishnakumar Peyyeti. Ld. Advocate for petitioner that there is no other petition is filed for Probate, Letters of Administration, Succession Certificate or Heirship Certificate in respect of the identical properties of the same deceased.
4. In view of the Notification dated 09.08.2024, office is directed to refund of court fees of Rs.65,000/- as per rules in the present petition. 06.08.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
