TP/3622/2025 (E-filing) WITH WILL/1383/2025 Mr. Jayesh Jain, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Devendra Sinh Solanki being sole Executor named under the Will of deceased. The deceased namely Nazir Hassan Shaikh died at Pune on 04.10.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Pune on 16.11.2019. The said Will is in English language. The Para No. 16 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at para No. 13 of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased died as bachelor. Deceased had one brother and two sisters. Out of them one sister and brother of deceased predeceased the deceased. As per para No. 8 of the petition, deceased was survived by only one sister who has given her consent on behalf of petitioner herein. Consent Affidavit is on record. There are no other legal heirs. Petitioner relied upon the Judgment of High Court of Andhra Pradesh at Hyderabad reported in 2003 SCC online AP 101.

4. Petitioner's oath is filed. Affidavit of Subhag Singh Bhati dated 29.03.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 18.09.2025 is filed. Administration Bond dated 26.11.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
