TP/3713/2025 (E-filing) WITH WILL/1389/2025 Mr. Dolly R. Padhiyar i/b. Prasad Das, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vasantibai Vasantkumar Jhaveri being sole Executrix named under the Will of deceased. The deceased namely Vasantkumar Narayandas Jhaveri died at Mumbai on 21.11.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 06.02.2003. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executrix. Only one Executrix appointed under the Will who is petitioner herein. The property mentioned in the Schedule I annexed to the petition is referred in the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by his widow, two sons and one daughter. Out of them widow is petitioner herein and one son and daughter have given their consents in favour of the petitioner herein. Consent Affidavits are on record. Another son of deceased has been served with the citation through newspaper publication and Affidavit of Service of publication dated 22.11.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Chandrakant Sharadprasad Singh dated 18.09.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation is not filed. Administration Bond dated 09.12.2025 is filed however, as the amount is of Rs. 42 crores, petitioner to produce the Income Tax Returns of Surety to consider the financial status of the said surety. Delay is explained and the same is condoned.

5. Ld. Advocate for petitioner to file praecipe for placing the matter on board as and when all compliance done in the matter. Hence, remove from board. 19.12.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
