TP/3717/2025 (E-filing) WITH WILL/1419/2025 Mrs. Nikita Sheth, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vipul Vrajlal Mehta being alternate Executor named under the Will of deceased. The deceased namely Vrajlal Bhagwanji Mehta died at Mumbai on 01.04.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 28.05.2005. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. First Executor namely Deenaben Vrajlal Mehta died on 18.12.2024 hence, petitioner is alternate Executor. Residuary clause in respect of properties of deceased is mentioned at para Nos. 7 and 9 of the Will.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Widow of deceased since deceased the deceased. One son of deceased namely Deven died leaving behind his widow and one son. Deceased was survived by one son, one daughter, one daughter-in-law and one grandson. Out of them son is petitioner herein and daughter has given her consent in favour of the petitioner herein. Consent Affidavits are on record. Widow and grandson of deceased have been served with the citation through newspaper publication and Affidavit of Service of publication dated 20.11.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Rameshchandra Ramnath Mishra and Suresh Krishna Lotlikar dated 05.07.2025 and 08.10.2025 both the Attesting Witnesses to the Will are filed respectively. Affidavit of Service of General Citation dated 26.09.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted. ....2
