TP/3829/2025 (E-filing) Ms. Sapna Sharma i/b. K Ashar and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of photocopy of last Will and Testament of deceased filed by petitioner namely Dilip Bhanushankar Trivedi being sole Executor named under the Will of deceased. The deceased namely Bhanushankar Kharashankar Trivedi died at Mumbai on 30.05.1994. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 08.04.2025 for non-availability of identification proof of deceased. The same is accepted.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 20.08.1993. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. The properties mentioned in Schedule I annexed to the petition is referred in the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Widow of deceased since deceased the deceased. Deceased was survived by two sons and one daughter. Out of them one son is petitioner herein and the another son and daughter have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dinesh Vinayak Rege dated 27.05.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 17.09.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
