1. While dictating the final order it is noticed that petitioner stated that there are no legal heirs of the deceased namely Hemant Rao. Later on, he has deleted the last three lines of the rider. I have perused the affidavit filed by the petitioner affirmed on 18.02.2026 in which he states that Hemant's heir is required to be mentioned in the petition. However, said affidavit is not corroborated the amendment which is introduced in a rider. Hence, petitioner to state about the legal heirs.
2. Perused the list given under Class-II of schedule appended to the Hindu Succession Act, 1956. Petitioner to state about the legal heirs of the said Hemant Rao falling under the category of the Class-(II) Entry-(II) to class-(II) Entry-(VII). Furthermore, other legal heirs whose names are mentioned at serial no. 2 to 5 are covered as per the Class-(II) Entry-(IX). Therefore, petitioner to state about the legal heirs of the said Hemant Rao falling under Class-II (II) to ClassII (VII) of the schedule given in Hindu Succession Act, 1956.
