TP/3942/2025 (E-filing) Ms. Swati Mathkar i/b. S. P. Mathkar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Parul Bharat Doshi being one of the Executors named under the Will of deceased. The deceased namely Taralaxmi Savailal Shah died at Mumbai on 10.06.1992. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 09.05.2025 for non-availability of identification proof of deceased. The same is accepted.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 05.01.1991. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will. Petitioner is one of the executors and another executor namely Dhanlaxmi D. Shah died as stated in para No. 5 of the petition and remaining executor namely Chetan D. Shah has renounced his rights to act as Executor and Affidavit dated 09.05.2025 is filed to that effect. Residuary clause in respect of properties of deceased is mentioned at para No. 9 of the Will.

3. Ld. Advocate for petitioner submits that husband and parents of husband of deceased predeceased the deceased. Deceased died issue-less. Deceased had one brother namely Dhirajlal who died leaving behind one son and two daughters. Deceased was survived by one nephew and two nieces. Out of them one niece is petitioner herein and the nephew and another niece have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Nilesh R. Modi dated 10.05.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 11.09.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
