This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Bomi Sorabji Ayrton being son-in-law of deceased Nos. 1 and 2 and husband of deceased No. 3. Deceased No. 1 namely Mahiar Danjishaw Dubash died intestate at Mumbai on 16.02.1982. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is already annexed to the petition. Deceased No. 2 namely Rati Mahiar Dubash died intestate at Mumbai on 23.02.2000. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is already annexed to the petition. Deceased No. 3 namely Arnavaz Bomi Ayrton died intestate at Mumbai on 03.05.2016. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased Nos. 1 and 2 were husband and wife. Both the deceased had only one daughter who is deceased No. 3. Deceased No. 3 was survived by her husband and one daughter. Out of them husband of deceased No. 3 is petitioner herein and the daughter has given her consent in favour of petitioner herein. Consent Affidavit is on record. There are no other legal heirs. As per para No. 10 of the petition, the securities mentioned in the Schedule I annexed to the petition were jointly held by all the three deceased.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 04.09.2025 and Administration Bond dated 02.09.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
