This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Perviz Behram Guzdar being niece of both the deceased . Deceased No. 1 namely Darabsha Rustomji Mistry died intestate at Mumbai on 06.10.2001. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition. Deceased No. 2 namely Khorshed Darabsha Mistry died intestate at Mumbai on 18.04.1996. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 07.07.2025 for non-availability of identification proof of deceased No. 2. The same is accepted.

2. Ld. Advocate for petitioner submits that as per amended para No. 4 of the petition, deceased Nos. 1 and 2 were husband and wife and they died issue-less. Deceased No. 1 had two sisters. One sister of deceased namely Khorshed Rustomji Mistry died as spinster and another sister of deceased namely Tehmina died leaving behind one son and one daughter. Both the deceased was survived by one niece and one nephew. Out of them niece is petitioner petitioner herein and nephew has given his consent in favour of petitioner herein. Consent Affidavit is on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 06.11.2025 and Administration Bond dated 10.11.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
