This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Sharad Sumtichand Jhaveri being son of deceased. Deceased No. 1 namely Sumatichand Suganchand Jhaveri died intestate at Mumbai on 02.06.1994. Copy of death certificate is annexed to the petition. Deceased No. 2 namely Indira Sumatichand Jhaveri died intestate at Mumbai on 21.11.1988. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 26.05.2025 for non-availability of identification proof of deceased Nos. 1 and 2. The same is accepted.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased were husband and wife. One son of both the deceased namely Shailesh died leaving behind his widow and died issue-less. Both the deceased were survived by one son and one daughter-in-law. Out of them son is Petitioner herein and the daughter-in-law has given her consent in favour of petitioner herein. Consent Affidavit is on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 29.10.2025 and Administration Bond dated 27.08.2025 are filed. Delay is explained and same is condoned.

4. However, statutory period of service of citation is not yet completed hence, matter is adjourned till 25.11.2025.
