This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioner namely Swamishekhar Kesarinath Mhatre being brother of deceased. Deceased namely Kunda Kesarinath Mhatre died intestate at Mumbai on 31.12.2019. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased died as spinster. Parents of deceased predeceased the deceased. Deceased was survived by one brother only who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 15.09.2025 is filed. As petitioner is sole surviving legal heir of the deceased before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained and same is condoned.

4. However, statutory period of service of citation is not yet completed hence, matter is adjourned till 07.10.2025.
