Perused Petition.

The petitioner, namely Manan Bhupendra Gala, has filed the petition for grant of the Letters of Administration in the respect of the properties left by the deceased, namely Purbai Kuvarji Gala @ Purbai Kunvarji Gala. Family Tree is given in page No. 3 of the petition. It is Perused.

Heard Ld. advocate for the petitioner. The deceased died as Widow and issueless. Husband's parents are predeceased. Hence, the Bhavanji H. Gala. The brother of the deceased's husband, is the legal heir vide Sec. 15(1)(b) read with Rule 3 of the Sec.17 of the Hindu Succession Act, 1956.

Bhupendra Gala is predeceased son of Bhavani H. Gala, died leaving behind his widow, one daughter and the son-Manan (Petitioner). Hence, as per Sec. 9 of the HS Act, the petitioner can not be heir of the deceased, in life time of Bhavanji H. Gala. Hence, petitioner to take steps to maintain this petition, by following due procedure in this regard. 5.
