TP/4350/2025 (E-filing) WITH WILL/1734/2025 Mr. Anthony Fernandes i/b. Ahmad Waquar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Pravina Khodidas Boricha being sole Executrix named under the Will of deceased. The deceased namely Lourence Concecio Crasto died at Mumbai on 12.12.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 16.08.2020. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executrix. Only one Executrix appointed under the Will. There is only one immovable property mentioned in the Schedule I annexed to the petition has referred in para No. 2 of the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased died issue-less. Deceased had no brother and sister. Wife of deceased had two sisters. Out of them one sister of wife of deceased predeceased the deceased, leaving behind one daughter. Deceased was survived by one sister-in-law and one niece who have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Maveena D'sousa and Salim Sayed dated 15.03.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation is not filed. Delay is explained and the same is condoned.

5. Ld. Advocate for petitioner file praecipe to place on board as and when matter is completely ready for final grant.
