This petition is for Succession Certificate in respect of certain debts and securities belonging to deceased filed by petitioner namely Vijay Kantilal Thanawala being brother of deceased No. 1 and brother-in-law of deceased No. 2. Deceased No. 1 namely Anil Kantilal Thanawala died intestate at Thane on 03.07.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition. Deceased No. 2 namely Usha Anil Thanawala died intestate at Thane on 24.08.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that parents of deceased No. 1 predeceased the deceased. Deceased Nos. 1 and 2 were husband and wife. Both the deceased died issue-less. One brother of deceased No. 1 namely Kanaiyalal died on 31.10.2024 leaving behind his widow and one son. Both the deceased No.1 was survived by two brothers, one sister-in-law and one nephew. Out of them brother is petitioner herein and another brother (through Constituted Attorney), one sister-in-law and one nephew have given their consents in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs. Deceased No.2 was survived by two brothers-in-laws, one sister-in-law and one nephew. Out of them one brother-in-law is petitioner herein and another brother-in-law (through Constituted Attorney), one sister-in-law and nephew have given their consents in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 16.09.2025 is filed. Administration Bond is not filed. Delay is explained and same is condoned.
