This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioners namely Manoj Bhavesh Soni and Mayank Bhavesh Soni being grandsons of deceased No. 1 and sons of deceased No. 2. Deceased No. 1 namely Muktaben Prabhudas Soni died intestate at Uttar Pradesh on 17.11.2001. Copy of death certificate is annexed to the petition. Petitioners have filed Affidavit dated 11.01.2025 for non-availability of identification proof of deceased No. 1 which is already annexed to the petition. The same is accepted. Deceased No. 2 namely Madhu Bhavesh Soni died intestate at Mumbai on 25.11.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased No. 2 namely copy of Aadhaar Card is already annexed to the petition.
2. Ld. Advocate for petitioner submits that deceased No. 2 is daughter-in-law of deceased No. 1. Husband of deceased No. 1 predeceased the deceased. Deceased No. 1 had one son namely Bhavesh and he died on 22.01.1989. Deceased No. 1 was survived by two grandsons who are petitioners herein. Husband of deceased No. 2 predeceased the deceased. Deceased No. 2 was survived by two sons who are petitioners herein. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 28.11.2025 and Administration Bond dated 28.11.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
