Advocate for petitioner seeks leave to sign the schedule I annexed to the petition. Leave is granted. Ld. Advocate for petitioner to re-upload the Petition on the official portal of the Bombay High Court within twelve weeks from the date of uploading of this order. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Agnelo Bruno Cardozo being sole Executor named under the Will of deceased. The deceased namely Bruno Xavier Cardozo died at Mumbai on 14.02.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 12.12.2018. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at first page of the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by one son who is petitioner herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Iona Cardozo dated 06.08.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 03.10.2025 is filed.

5. However, statutory period of service of citation not yet completed hence, matter is adjourned till 17.10.2025.
