TP/4611/2025 (E-filing) WITH WILL/1772/2025 Ms. Pranjali Bhandari, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Zarin Michael Davis being sole surviving Executor named under the Will of deceased. The deceased namely Hilla Erach Kavina died at Nashik on 29.10.1993. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Nashik on 10.12.1992. The said Will is in handwritten in English language. The 2nd para of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and another executor namely Michael Davis died as stated in para No. 6 of the petition. Residuary clause in respect of properties of deceased is mentioned at para No. 4 on 4th page the Will.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by one daughter only who is petitioner herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dr. Asha Subodh Pandit dated 16.01.2018 one of the Attesting Witness to the Will is filed however, the said Affidavit is of year 2018 hence, Advocate to take steps under Rule 384 of the Bombay High Court (Original Side) Rules, 1980. Affidavit of Service of General Citation dated 03.11.2025 is filed. Delay is explained and the same is condoned.

5. Ld. Advocate for petitioner file praecipe to place on board as and when matter is completely ready for final grant.
