TP/4648/2025 (E-filing) WITH WILL/1760/2025 Ms. Jigisha Jethwa, Advocate for petitioners PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Aditya Ashwinikumar Tripathi and Abhay Ashwinkumar Tripathi being Executors named under the Will of deceased. The deceased namely Suryanarayan Sitasharan Tripathi died at Pune on 25.01.2025. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Pune on 18.04.2006. The said Will is in English language. The Para No. 4 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein. Petitioners are alternate executors and first executor namely Ashwinkumar Tripathi died as stated in para No. 8 of the petition. The properties mentioned in Schedule I annexed to the petition is referred in para No. 2 of the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. One son of deceased namely Ashwinkumar died leaving behind two sons. Details of Widow of son of deceased namely Ashwinkumar not stated in the petition hence, Advocate to take steps accordingly. Deceased was survived by one daughter-in-law and two grandsons. Out of them two grandsons are petitioners herein and Consent Affidavit of daughter-in-law is not filed. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Sameer Arun Joshi dated 30.06.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 25.10.2025 is filed. Delay is explained and the same is condoned.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is completely ready for final grant.
