TP/4654/2025 (E-filing) Mr. Wajid Shaikh, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Jita Hemant Shah being one of the Executrices named under the Will of deceased. The deceased namely Hemant Navinchandra Shah died at Mumbai on 06.08.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 11.02.2020. The said Will is in English language. The Para No. 2(a) of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and Affidavit of Reserving / Renouncing the rights of another executor namely Sunil Saurashtri is not filed. Residuary clause in respect of properties of deceased is mentioned at para No. 12 of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by his widow and two married daughters. Out of them widow is petitioner herein and both the married daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Sanjiv Piyush Jhaveri dated 09.07.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 09.10.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is completely ready for final grant.
