TP/4745/2025 (E-filing) Ms. Disha Khatanhar a/w. Risa Rodrigues i/b. DM Harish and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioner namely Raksha Khushalani being one of the Executrices named under the Will of deceased. The deceased namely Hiroo Lilaram Khushalani died at New Delhi on 10.03.2025. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at New Delhi on 26.05.2014. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor namely Mira Khushalani and Codicil refers to the appointment of Mira Khushalani and Raksha Khushalani also. Only two Executrices appointed under the Will. Petitioner is one of the executors and another executrix namely Mira Khushalani has reserved her rights to act as executrix and Affidavit dated 24.07.2025 is filed to that effect. Residuary clause in respect of properties of deceased is mentioned at 1st page of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by his widow, one son and one daughter. Out of them daughter is petitioner herein and the widow and son have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Two Affidavits of Dr. M M Paithankar dated 14.07.2025 one of the Attesting Witnesses to the Will as well as Codicil are filed. Affidavit of Service of General Citation dated 18.10.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
