TP/4796/2025 (E-filing) WITH WILL/1846/2025 Mr. Anand Tiwari i/b. Sachchidanand Singh, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Ranjeet Noba Eppili being sole Executor named under the Will of deceased. The deceased namely Jagdamba Prasad died at Gonda, Uttar Pradesh on 04.09.2017. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 27.10.2024 for non-availability of identification proof of deceased which is annexed to the petition. The same is accepted.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 20.05.2012. The said Will is in English language. The last para of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. The property mentioned in Schedule I annexed to the petition is referred in the Will.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Deceased was survived by his widow and one son who have been served with the citation through the office of Sheriff, Mumbai and Affidavit dated 01.12.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Tankia J. Epili dated 27.12.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 01.12.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
