Heard Mr. Fernandes, learned Advocate for Petitioner. 3.

Petition seeks issuance of Grant which is filed by wife of deceased. Son and daughter are the other legal heirs. Consents are appended from page No.43 onwards. I have perused the same. They are in order.

Petitioner has filed Court fees of Rs.75,000/-. In view of Government Resolution in terms of Section 46 of Court Fees Act, 1976 Petitioner is entitled to refund of Court fees of Rs.65,000/- which Department shall forthwith refund to her on the basis of server copy of this order. There can be no impediment in allowing the present Petition. Petition stands allowed in terms of prayer clause which reads

P9.tp.4929.2025.doc thus:- "The Petitioner therefore prays that : a Succession Certificate may be granted to the Petitioner in respect of Debts and securities set forth in Schedule-B hereto annexed with the power to collect the said Debts and securities with all interest and benefits accrued thereon." 5.

Grant shall be issued by the Testamentary Department subject to all due compliances and removal of office objections. 6.

Petitioner shall provide the bank details in the Testamentary Department alongwith server copy of this order. Department shall refund the excess Court fees paid by Petitioner of Rs.65,000/- within a period of one week from date of submission of details of bank account of Petitioner to Department unfailingly.

Petitioner is directed to provide bank details and Department is directed to refund the excess amount of Court fees of Rs.65,000/- within a week on receiving those details from Petitioner. 8.

Petition is allowed and disposed.

9.

Praecipe is also disposed.
