1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Umesh Yashavant Sane being sole Executor named under the Will of deceased. The deceased namely Ramchandra Dhondo Sane died at Mumbai on 05.02.2003. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 10.09.2025 for non-availability of identification proof of deceased which is annexed to the petition. The same is accepted.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 24.03.2002. The said Will is in Marathi language and official translation of the said Will received from the office of Chief Translator, High Court, Bombay has been uploaded separately on the official portal of the Bombay High Court. The Para No. 3 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at para No. 4 of the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased died issue-less. Deceased had five sisters and three brothers. Out of them two brothers and two sisters were predeceased the deceased. Remaining one brother and three sisters are since deceased the deceased and their legal heirs are mentioned in para No. 8 of the petition. Deceased was survived by six nephews and four nieces who all have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Both the original Attesting Witnesses to the Will have expired as stated in para No. 5 of the petition therefore, petitioner has filed Affidavit of Dr. Pankaj Arvind Oak (undated and without any registered serial number) is filed under Rule 384 of the Bombay High Court (Original Side) Rules, 1980 hence, Advocate to take steps accordingly. Affidavit of Service of General Citation dated 26.11.2025 is filed. Delay is explained and the same is condoned.

5. Liberty to move for listing the matter on compliance of requisition stated in Bold hereinabove.
