TP/5063/2025 (E-filing) WITH WILL/1955/2025 Ms. Kunjan Chheda i/b. Dipti Nagda, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Praful Pranlal Mehta and Rajiv Sharadchandra Mehta being Executors named under the Will of deceased. The deceased namely Sharadchandra Pranlal Mehta died at Mumbai on 25.09.2018. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 23.12.2016. The said Will is in English language. The 2nd last para of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners. Residuary clause in respect of properties of deceased is mentioned at 1st page last para of the Will.

3. Details of parents of deceased are not mentioned in the petition. Ld. Advocate for petitioner submits that deceased was survived by his widow, one son and two daughters. Out of them son is petitioner No. 2 herein and widow and two daughters have given their consents in favour of the petitioners herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Kalpana D. Mehta and Shilpa P. Mehta dated 09.08.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 07.11.2025 is filed. Delay is explained and the same is condoned.
