TP/5187/2025 (E-filing) WITH WILL/1999/2025 Mr. Pranesh Gada, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Vishwas Anant Joshi and Subhash Anant Joshi being Executors named under the Will of deceased. The deceased namely Anant Raghunath Joshi died at Mumbai on 15.05.1999. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 13.01.1996. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will. Two executors are petitioner herein and remaining executrix namely Nirmala Anant Joshi died on 11.02.2015 as per para No. 17 of the petition. Residuary clause in respect of properties of deceased is mentioned at para No. 5(g) of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Widow of deceased since deceased the deceased. Deceased was survived by two sons and one daughter. Out of them both the sons are petitioners herein and daughter has her consent in favour of the petitioner herein. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. As per para Nos. 5(a) of the petition both the original Attesting Witnesses to the Will have died hence, petitioners have filed Affidavit of petitioner No. 1 as an Affidavit of Attesting Witness however, it is incomplete. Advocate to take steps accordingly. Affidavit of Service of General Citation dated 17.11.2025 is filed. Delay is explained and the same is condoned.

5. Ld. Advocate for petitioner file praecipe to place on board as and when all compliance is done in this matter.
