1. Perused Petition. Heard Ld. Advocate for petitioner. By an order dated 27.01.2026 this Hon'ble Court has dispensed with the requisition raised in the order dated 20.01.2026. The said requisition was with regard to maintainability of the present petition as Probate Petition. Also, office is directed to proceed in accordance with law.

2. This petition is for Probate with an authenticated copy of last Will and Testament alongwith one Codicil of deceased filed by petitioners namely Rosemarie Agnes Read and Gary John Thaddeus being Executors named under the Will of deceased. The deceased namely John Erskine David Hopcroft died at United Kingdom on 20.12.2019. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is annexed to the petition.

3. The Probate was already issued by the District Registrar, in Family Division of High Court of Justice and Certificate was granted by High Court of Justice England and Wales, in respect of Will dated 04.07.2005 with one Codicil dated 30.05.2012. The copy of the said grant is annexed to the petition as Exhibit - "B". As per para No. 1 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will, out of them two are petitioners herein.

4. Affidavit of Service of General Citation dated 24.11.2025 is filed. Delay is explained in para No. 9 of the petition and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
