Perused Petition.

Petition for letters of administration for the properties left by the deceased, namely MEHUL SHASHIKANT SAGALIYA, has been filed by the Mother and brother of the deceased. Deceased was Hindu and died unmarried. Hence, only the Petitioner no.1, BHARATI SHASHIKANT SAGALIA, being the mother is the surviving class-I legal heir of the deceased, as per the provisions of the Hindu Succession Act, 1956. Hence, the petitioner No. 2 has no right to present the petition, being the heir of the deceased. Hence, the petitioner to take steps to delete the name of the petitioner No.2 from the petition, by following due procedure laid down in this regard.
