TP/5432/2025 (E-filing) WITH WILL/2027/2025 Ms. Rasika Pawar a/w. Atish Mahade i/b. Swati Gawde, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Shishir Tahkorlal Parikh being one of the Executors named under the Will of deceased. The deceased namely Asha Thakorlal Parikh died at Pune on 08.05.2025. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 07.06.2022. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will. Petitioner is one of the executors and other executors namely Varsha Parag Parikh and Rutul Hemant Parikh have reserved their rights to act as an Executors and Affidavit 06.10.2025 and 03.09.202025 are filed to that effect. The Schedule I annexed to the petition has referred one immovable property which is shown at para No. 5.01 of the Will.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. One son of deceased namely Hemant predeceased the deceased and his wife also died, leaving behind his one son. Deceased was survived by one son, one daughter and one grandson. Out of them son is petitioner herein and the daughter and grandson have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Leena Parikh and Bindu Sanghvi dated 03.09.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 03.12.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
