Heard Ld. Advocate for petitioner as well as Intervenor. Ld. Advocate for Applicant in IAL No. 41251 of 2025 which is filed today on behalf of daughter-in-law namely Stuti Shiva Kabra however, there is no stay as not to proceed with the petition. Therefore, I proceed with the petition.

2. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Ritu Kabra Joshi and Amisha Himatsingka being Executors named under the Will of deceased. The deceased namely Pushpa Kabra died at Mumbai on 04.05.2025. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

3. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 17.04.2025. The said Will is in English language. The Para No. 4 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein. Residuary clause in respect of properties of deceased is mentioned at para No. 14 of the Will.

4. Ld. Advocate for petitioner submits that deceased was survived by her husband, one son and two daughters. Out of them both the daughters are petitioners herein and the husband and son have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

5. Petitioner's oath is filed. Affidavit of Deepak Bhat dated 25.09.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 24.11.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

6. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed and aslo after verifying the order that may be passed in the said Interim Application.
