TP/5584/2025 (E-filing) WITH WILL/2052/2025 Mr. S. U. Lakdawala, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Shirin Hasnoor Daruwalla being one of the Executrices named under the Will of deceased. The deceased namely Freny Firoze Paghdiwala died at Mumbai on 17.10.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 17.10.2020. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only five Executors appointed under the Will. Petitioner is one of the executrices and two executors namely Firoze J. Paghdiwala and Rustom R. Dalal died as stated in para No. 5 of the petition and remaining two executors namely Niloufer H. Elavia and Mahazaver R. Dalal have reserved their rights to act as an Executors and Joint Affidavit dated 17.10.2025 is filed to that effect. Residuary clause in respect of properties of deceased is mentioned at para No. 30 of the Will.

3. Ld. Advocate for petitioner submits that parents and parents of husband of deceased predeceased the deceased. Deceased died issue-less. Husband of deceased since deceased the deceased who died on 20.10.2024. Husband of deceased had married twice during his lifetime. From the first wife, husband of deceased had one son. Deceased had divorced his first wife by the decree of divorced of the Hon'ble Court and deceased being the second wife of her husband and had no issue. Deceased was survived by one step son who has given his consent in favour of the petitioner herein. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Katy Pervez Movewalla dated 17.10.2025 one of the Attesting Witness to the Will is filed. ......2

SLG -- 2 -- Affidavit of Service of General Citation dated 24.11.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
