1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vaishali Anant Ghanekar, being sole Executor named under the Will of deceased. The deceased namely Savitri Shnataram Pavaskar, who died at Thane on 20.01.2012. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is annexed to the petition.
2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 11.08.2011. The said Will is in Marathi language. Affidavit of Translation is absent. The Para No. 4 of the Will refers to the appointment of Executor. Sole Executor appointed under the Will. Schedule refers to only one immovable property situated in Mumbai, which is referred in the Will at para 6.
3. Ld. Advocate for petitioner submits that husband and parents of deceased predeceased the deceased. Deceased was survived by three daughters. All three daughters have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.
4. Petitioner's oath is filed. Affidavit of Ashok Dattaram Chavan dated 15.09.2025 one of the Attesting Witness to the Will is filed and Affidavit of Bharat Yashwant Pedamkar dated 15.09.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 09.12.2025 is filed. Delay is explained and the same is condoned.
5. Petitioner has not filed the official translation from the Office of Chief Translator nor Advocate had filed the Affidavit certifying the true and correct translation, Advocate to take steps accordingly. 28.01.2026 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
