1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioners namely Mukesh Padamshi Negandhi and Varsha Hemant Kapadia being brother and sister of deceased respectively. Deceased namely Bhupendra Padamshi Negandhi died intestate at Palghar on 26.05.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.
2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased died as bachelor. Deceased had two brothers and three sisters. Out of them one brother namely Vijay Sinh predeceased the deceased who died as bachelor. One sister of deceased namely Chandraben predeceased the deceased, who died as spinster. Another sister of deceased namely Veermati died issue-less and her husband also died. Deceased was survived by one brother and one sister who both are petitioners herein. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 09.01.2026 is filed. As all surviving legal heirs of the deceased are petitioners before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
