This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Abbas Mohammedally Koita being nephew of deceased. Deceased namely Amina Taiyebali Koita died intestate at Mumbai on 09.05.2018. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased died as spinster. Parents of deceased predeceased the deceased. Deceased had two brothers. One brother of deceased namely Ismalibhai died as bachelor. Another brother of deceased namely Mohammedali died leaving behind one son. Deceased was survived by one nephew who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice 11.12.2025 is filed. and Administration Bond are filed. As sole surviving legal heir of the deceased is petitioner before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
