1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Mayank Ajaykumar Kori being sole Executor named under the Will of deceased. The deceased namely Shyam Shantaram Mahakal died at Thane on 04.07.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 14.01.2020. The said Will is in Marathi language and translation of the said Will is annexed to the petition however, Affidavit of Advocate on record certifying that the said translation is true and correct is not filed. The Para No.4 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. The immovable property mentioned in Schedule I annexed to the petition which is referred in para No. 6 of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by his widow and two sons who all have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Gopal Pundalik Basutkar and Amit Rajaram Naarkar dated 30.07.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 11.12.2025 is filed. Delay is explained and the same is condoned.

5. Liberty to move for listing the matter on compliance of requisition stated in Bold hereinabove.
