This petition is for Succession Certificate in respect of certain Securities belonging to deceased filed by petitioner namely Atul Jayantilal Shah, who is Son of deceased. Deceased (a) namely Jayantilal Chandulal Shah, said to be died intestate at Mumbai on 27.11.1997. Copy of death certificate is annexed to the petition as Exhibit - "A". Petitioner has filed Affidavit dated 01.11.2025 for identification proof of the deceased.
Deceased (b) namely Prabhavati Jayantilal Shah, said to be died intestate at Mumbai on 05.07.2016. Copy of death certificate is annexed to the petition as Exhibit - "A". Identification proof the deceased (b) copy of passport is annexed to the petition.
2. Ld. Advocate for petitioner submits that deceased a and b were husband and wife. Parents of the deceased predeceased the deceased. Deceased was survived by one son and one daughter. Out of them son is petitioner and daughter has given her consent. Consent Affidavits is on record. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 16.12.2025 and Administration Bond dated 05.12.2025 are filed separately through e-filing. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
