TP/6138/2025 (E-filing) WITH WILL/2318/2025 Ms. Pushpa Thapa, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of two deceased filed by two petitioner namely Prabhakar Krishanayya Shetty and Pradeep Kumar Jha, both being Executors named under the Will of deceased. The deceased no. (1) namely Shukantala Devi Mishra, who died at Borough, Kolkata, West Bengal, on 04.10.2023 Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition. The deceased no. (2) namely Parmanand Mishra, who died at Mumbai on 01.03.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The both deceased left behind Joint last Will and Testament which was duly executed at Mumbai on 15.12.2022. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of Executor. Only two Executor appointed under the Will, who both are petitioners herein. Schedule refers to the in schedule of the petition, which are mentioned in the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by one son and married daughter, both have given their consent in favour of the petitioners. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ashish Jha dated 30.09.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 18.12.2025 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
