1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Niranjan Anopchand Sanghvi being son of deceased. Deceased No. 1 namely Hiraben Anopchand Sanghvi died intestate at Mumbai on 12.06.2007. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition. Deceased No. 2 namely Anopchand Popatlal Sanghvi died intestate at Mumbai on 02.07.2007. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Relation between both the deceased not stated in the petition. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by one son only who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice is not filed. As sole surviving legal heir of the deceased is petitioner before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained and same is condoned.

4. Liberty to move for listing the matter on compliance of requisition stated in Bold hereinabove.
