In that view of the matter, the order dated 06.03.2026 needs to be implemented immediately.

This Petition seeks issuance of probate in respect of the last Will and Testament of Madhulata Pravinchandra Shah. Petition is filed by the Executors named in the Will.

Consent Affidavits dated 31.10.2025 of Hasumati Jitendra Mehta, Sheetal Kamalnayan Kapadia and Ameesha Aditya Dalmia are

P1.TP.6338.2025.doc appended at page Nos.34, 39 and 44 to the Petition. I have perused the same. The same are in order.

For the averments mentioned in the Petition and the reasons in the praecipe which are considered by the Court, there can be no reason to disbelieve the same and therefore Testamentary Petition is allowed in terms of the unnumbered prayed clause which reads thus:- "The Petitioners prays that the probate may be granted to Petitioners having effect throughout the State of Maharashtra." 8.

Testamentary Department is directed to issue grant / probate having effect throughout the State of Maharashtra subject to all other compliances and strictly in accordance with law within a period of one week from today positively.

With the above direction, Testamentary Petition stands disposed.
