1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate (De Bonis Non) in respect of certain securities belonging to deceased filed by petitioner namely Nisha Priscilla Desouza being daughter of deceased. Deceased namely Philomena Gratian Dsouza died intestate at Mumbai on 18.06.2015. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Husband of deceased since deceased the deceased. Deceased had two sons and two daughters. One son of deceased namely Samir died as bachelor. One daughter of deceased namely Gita died as spinster. Deceased is survived by one son and one daughter. Out of them daughter is petitioner herein and son has given his consent in favour of petitioner herein. Consent Affidavit is on record. There are no other legal heirs.

3. Son of deceased had filed Succession Certificate being TP No. 1872 of 2018 for the estate of deceased however, he died on 12.08.2022 who since deceased the deceased, without administering the estate of deceased. Hence, office is directed not to treat as cross petition.

4. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 30.12.2025 and Administration Bond dated 13.02.2026 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Succession Certificate as prayed after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed. 23.03.2026 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
