1. Perused Petition. Heard Ld. Advocate for petitioners. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Ravilal Keshara Patel and Harilal Keshara Patel being Executors named under the Will of deceased. The deceased namely Ramanlal Keshra Patel died at Mumbai on 14.08.1980. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 11.11.2025 for non-availability of identification proof of deceased which is annexed to the petition. The same is accepted.
2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 29.07.1980. The said Will is in Gujarati language and translation of the same is annexed to the petition and Affidavit of Advocate is on record dated 14.01.2026 certifying that the said translation is true and correct. The Para No.2 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein. The property mentioned in Schedule I annexed to the petition has referred in para No. 1(E) of the Will.
3. Ld. Advocate for petitioner submits that parents of deceased since deceased the deceased. Deceased died as bachelor. Deceased was survived by four brothers and two sisters. Out of them two brothers are petitioners herein and all other legal heirs have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.
4. Petitioner's oath is filed. As per para No. 5 of the petition, both the original Attesting Witnesses to the Will died therefore, petitioner has filed Affidavits of Hiralal Patel dated 08.10.2025 and Ratilal Patel dated 11.11.2025 are filed in compliance of the provisions of Rule 384 of the Bombay High Court (Original Side) Rules, 1980. Affidavit of Service of General Citation dated 07.01.2026 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.
5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
