Present Misc. Petition is filed by Petitioners for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased Jijabai Tukaram Kadam. The names and details of legal heirs of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph No.7 of the Petition. I have perused the same.

Consent affidavits dated 11.11.2025 and 13.11.2025 of Anjali Mahesh Patil Alias Anjali Ashok Kadam, Anita Milind Jadhav

M5.MPT.175.2026.doc Alias Anita Ashok Kadam and Shraddha Mohan Kadam, the legal heirs are filed on record and appended at page Nos.37, 40 and 43 of Petition.

In view of the above, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clause 'A' which reads thus:- "A) This Hon'ble Court be pleased to issue a Legal Heirship Certificate to the Petitioners as mentioned in para 4 above under the provision of Bombay Regulation Act VIII of 1827 certifying that (1) Anuradha Murlidhar Utekar Alias Anuradha Tukaram Kadam, married daughter and Petitioner No.1 abovenamed and

(2) Sarojini Shivaji More Alias Sarojini Tukaram Kadam Petitioner No.2, Daughter of the deceased Abovenamed, and (3) Anjali Mahesh Patil Alias Anjali Ashok Kadam, Grand Daughter of the Deceased abovenamed and (4) Anita Milind Jadhav Alias Anita Ashok Kadam, Grand Daughter of the deceased Abovenamed and (5) Shraddha Mohan Kadam, Grand Daughter of the deceased abovenamed, all are the legal heirs of the deceased abovenamed."

Issuance of proclamation stands dispensed with. 7.

Department is directed to issue the legal heirship certificate as directed above within a period of 3 weeks from today positively. 8.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
