Heard the learned counsel for the Petitioner. It is pointed out that this Court had vide order dated 30th April 2025 allowed the Miscellaneous Petition in terms of prayer Clause (a) which reads thus:
"a. Legal Heirship Certificate of the Deceased be issued under the provision of the Bombay Regulation VIII of 1827, certifying that Divyaprakash Vedprakash Shrivastava (son of the Deceased abovenamed and the Petitioner herein) is one of the heir and legal representative of the Deceased in respect of the immovable properties as mentioned at Sr. Nos.1, 2, 3 and 4 and the bank accounts and credits as mentioned at Sr. No.5 in Schedule of Properties, annexed to the Petition at Exhibit - "E". "

It is however pointed out that the office while issuing a Legal Heirship Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:
2025.07.21 15:45:05 +0530 SAJAKALI LIYAKAT JAMADAR Certificate included the names of all the other legal heirs of the deceased. Learned counsel submits that this is therefore not in accordance with the prayer that was granted. It is further pointed out that the consents of the other legal heirs have S.L.Jamadar
2 1-MPT-250-2025.doc been given and are appended along with Miscellaneous Petition for the grant of Legal Heirship Certificate as prayed for in terms of prayer Clause (a). 3.
Having due regard to the submissions made, the Registry is directed to issue a Legal Heirship Certificate in terms of prayer Clause (a) which mentions only the name of the Petitioner.
