Heard Ms. Hunnurkar, learned Advocate for Petitioners and Mr. Dubey, learned Advocate for legal heir - Ms. Pallavi Desai. 2.

Order dated 07.01.2026 stands complied with. Appropriate affidavit of issuance of proclamation and service has been shown to the Court. Incidentally at this juncture, Mr. Dubey, learned Advocate on instructions appears to represent and espouse the cause of nonconsenting legal heir - Ms. Pallavi Desai. He undertakes to file Vakalatnama within a period of one week from today to represent Ms. Pallavi Desai. Department shall accept the same. 3.

In view of the prayer clause (a), there can be no impediment in allowing the Petition. Issuance of any further proclamation stands

Petition is allowed in terms of prayer clause (a) which reads thus:- "(a) That this Hon'ble Court be pleased to issue a legal Heirship Certificate to the Petitioner under the provisions of Bombay Regulation Act VIII of 1827 certifying that (1) Priya Prakash Sukhija (2) Mehek Avinash Jumani and (3) Pallavi Desai Nee Pallavi Prakash Sukhija, are the only heirs and legal representatives of the deceased.

Issuance of proclamation stands dispensed with. 5.

Department is directed to issue the legal heirship certificate as directed above within a period of 2 weeks from today positively. 6.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department. It is clarified that the 2 week period shall start from the date of removal of office objections.
