The Petitioners seeks issuance of a Legal Heirship Certificate under Section 2 of the Bombay Regulation VIII of 1827 in respect of one Padmakar Dattatray Vartak.

2. The deceased died intestate. The legal heirs and next-of-kin are mentioned in paragraph No.4 of the Petition. Consent Affidavit of other legal heir is at pages 39 to 43 of the Petition.

3. The Legal Heirship Certificate is sought to facilitate the transfer of property mentioned in Schedule of Property annexed as Exhibit 'I' to the Petition.

4. In view of the aforesaid submissions and the material placed on record and the reasons stated in paragraphs 5, 6 and 7 to the Petition, I find no impediment in allowing the Petition. The Petition is allowed.

5. The requirement of proclamation is dispensed with.
