Heard Mr. Solanke , learned Advocate for Petitioners. 2.

In compliance of the order dated 18.12.2025, Affidavits of service dated 03.01.2026 and 08.01.2026 are filed on the record. The same is perused by me. It is in order.

Present Misc. Petition is filed by Petitioner for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased Rasiklal Jamnadas Jariwala. The names and details of legal heirs of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph No.10 of the Petition. I have perused the same.

In view of the above, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms

20.MPT.337.2025.doc of prayer clause 'a' which reads thus:- "(a) This Hon'ble Court may be pleased to grant Legal Heirship Certificate thereby certifying that (I) Sanat Rasiklal Jariwala, (ii) Sarju Rajul Jariwala, (iii) Mukesh Rasiklal Jariwala and (iv) Tasvira Vasant Parmar are recognized as the legal heirs and representatives of Rasiklal Jamnadas Jariwala, the Deceased abovenamed."

Issuance of proclamation stands dispensed with. 6.

Department is directed to issue the legal heirship certificate as directed above within a period of 3 weeks from today positively. 7.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
