Heard Mr. Savla, learned Advocate for Petitioner. 2.

Present Misc. Petition is filed by the Petitioner for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of properties and credits of deceased Madhav Samba Sannabhadti. The names of the legal heirs of the deceased are mentioned in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph No.7 of the Petition. I have perused the same.

Consent affidavits dated 18.04.2025 of (1) Jaya Gajanan Hegde; (2) Deepak Madhav and (3) Ashok Madhav Sannabhadti are filed on record and appended at page Nos. 45, 48 and 51 respectively of the Petition.

In view of the above, there can be no impediment in

21.MPT.366.2025.doc allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clauses (a) and (b) which read thus:- "(a) That a Legal Heirship Certificate be issued under the provision of Bombay Regulation Act VIII of 1827 certifying that (1) Uma Madhav Sannabhadti (Wife of the deceased and the Petitioner herein), (2) Jaya Gajanan Hegde (eldest daughter of the deceased abovenamed), (3) Deepak Madhav Sannabhadti (elder Son of the deceased abovenamed) and (4) Ashok Madhav Sannabhadti (Youngest Son of the deceased abovenamed), are the only heirs and legal representatives of the deceased above named."

(b) That issuance of proclamation stands dispensed with;" 5.

Department is directed to issue the legal heirship certificate as directed above within a period of three (3) weeks from today. 6.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Registry.
