Heard Mr. Patil, learned Advocate for Petitioner. 2.

Present Misc. Petition is filed by Petitioner for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased Ganpat Ratnu Navale. The names and details of legal heirs of the deceased are stated in paragraph No.4 of the Petition. Purpose for filing the present Petition is stated in paragraph No.8 of the Petition. I have perused the same.

Joint notarised Relinquishment Affidavit dated 30.11.1985 of (1) Mr. Narayan Ganpat Nawale, (2) Indirabai Shankar Hatim, (3) Laxmibai Anant Adsul and (4) Suhashini Govind Matte, the legal heirs of the deceased being brother and sisters have relinquished their rights in favour of the deceased - brother is filed on record and appended at

page No.40 of the Petition.

Joint consent affidavit dated 06.02.2025 of (1) Suryakant Vishram Kanse, (2) Shravanika Nilesh Kharat (Nee: Smt. Shravanika Suryakant Kanse), (3) Chaitali Swapnesh Sakpal (Nee: Smt. Chaitali Suryakant Kanse) and (4) Siddhesh Suryakant Kanse, the legal heirs is filed on record and appended at page No.49 of Petition. 5.

Joint consent affidavit dated 06.02.2025 of (1) Shrikant Ramchandra More, (2) Ratnakar Shrikant More and (3) Nimesh Shrikant More, the legal heirs is filed on record and appended at page No.53 of Petition.

Joint consent affidavit dated 06.02.2025 of (1) Shubham Gopichand Navale and (2) Sampada Gopichand Navale, the legal heirs is filed on record and appended at page No. 57 of Petition. 7.

Joint consent affidavit of (1) Geeta Govind Navale (Nee: Geeta Ravindra Dhumak) and (2) Smita Govind Navale (Nee: Prathna Janardhan Salkar), the legal heirs is filed on record and appended at page No. 65 of Petition. Other legal heirs have pre - deceased the Petitioner their death certificates are appended at page Nos.45, 46, 47 and 48.

In view of the above, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms

of prayer clause 'a' which reads thus:- "a) That the Heirship certificate be granted to him to certify that 1)Suryakant Vishram Kanse, 2)Shravanika Nilesh Kanse nee Sravanika Nelesh Kharat, 3) Chaitali Suryakant Kanse nee Chaitali Swapnesh Sakpal, 4)Siddhesh Suryakant Kanse, 5) Shirkant Ramchandra More, 6) Ratnakar Srikant More, 7)Nimesh Shrikant More, 8)Geeta Govind Navale nee Geeta Ravindra Dhumak, 9) Smita Govind Navale nee Prathana Janardhan Salkar, 10)Sonali Gopichand Navale, 11)Shubham Gopichand Navale, 12)Sampada Gopichand Navale are the legal heirs and representative of the said deceased under the Provisions of the the Bombay Regulation Act, VIII of 1827 with respect to the property mentioned in the Schedule (Exh-D hereto)." 9.

Issuance of proclamation stands dispensed with. 10.

Department is directed to issue the legal heirship certificate as directed above within a period of 3 weeks from today positively. 11.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
