Present Misc. Petition is filed by Petitioner for issuance of legal heirship certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the properties and credits of deceased Sureshkumar Gajesingh Chindaliya. The names and details of legal heirs of the deceased are stated in paragraph No.2 of the Petition. Purpose for filing the present Petition is stated in paragraph No.5 of the Petition. I have perused the same.

Consent affidavits dated 28.12.2024 of (1)Vimla Sureshkumar Chindaliya, (2)Kavita Devi Sureshkumar Chindaliya, (3)Kumari Neetu Sureshkumar Chindaliya and (4)Nishant Sureshkumar Chindaliya, the legal heirs are filed on record and

14.MPT.397.2025.doc appended at page Nos.21, 24, 27 and 30 of Petition. 4.

In view of the above, there can be no impediment in allowing the Petition. Misc. Petition is allowed and disposed of in terms of prayer clause 'a' which read thus:- "'a'

That the Heirship Certificate may be granted certifying that Petitioner Sunny Suresh Chindaliya @ Sunny Sureshkumar Chindaliya being the Son of the deceased, and Vimla Sureshkumar Chindaliya widow of the deceased, Kavita Devi Sureshkumar Chindaliya @ Kavita Devi Rajesh and Kumari Neetu Sureshkumar Chindaliya, daughters of the deceased and Nishant Sureshkumar Chindaliya, Son of the deceased to be declared as the legal heirs and legal representative of the deceased under the provision of Section 2 of the Bombay Regulation Act VIII of 1827."

Issuance of proclamation stands dispensed with. 6.

Department is directed to issue the legal heirship certificate as directed above within a period of 3 weeks from today positively. 7.

Misc. Petition is allowed and disposed subject to compliance of office objections, if any, forthwith which shall be allowed by the Department.
